General Conditions of Use

These general conditions of use (hereinafter referred to as the “GCU”) define the conditions under which the Regional Tourism Committee of Brittany (hereinafter referred to as the “RTC”) authorises, in a non-exclusive way, the user of the picture library (hereinafter referred to as the “User”) to reproduce and/or represent the Photographs which are accessible on the website “http://www.tourismebretagne-photos.com” (hereinafter referred to as the “Photographs”).

By clicking the “I accept” button located at the bottom of the page, the User acknowledges that they have read and explicitly accept without reservation the stipulations of the GCU and, as a result, the User undertakes to comply with the GCU as a whole.

1. Authorisation to use the Photographs granted to Users by the RTC.

1.1. The RTC authorises the User, without charge and in a non-exclusive way, to reproduce and represent the Photographs, subject to strict compliance by the User with the conditions defined below.

1.2. The User must be an individual.

1.3. The User undertakes to be actively involved in tourism in Brittany. In this context, this concerns the following people: staff or members of the RTC; staff or members of institutional or associational partners of the RTC, especially, without the following list being in any way limitative, those such as the Regional Council of Brittany, Departmental Tourism Committees, Tourist Offices, Tourist Information Centres and Tourist Areas; professionals in the tourist sector as they are defined by the French Ministry of Economy, Industry and Employment.

1.4. It is absolutely essential and explicit that the Photographs are to be linked to content which promotes and enhances Brittany as a tourist destination, in France or abroad, to the exclusion of any other use. In particular, the User undertakes not to use the Photographs solely for the promotion of the organisation they belong to or of its corporate image.

1.5. The Photographs can only be reproduced or represented by the User within the context of press articles or in media which are distributed to the public free of charge, especially, without the following list being in any way limitative or prescriptive, those such as brochures, pamphlets, leaflets, posters, guides, websites, CD-ROMs giving tourist information, etc.

1.6. The User undertakes not to use the Photographs:

  • In any media marketed to the public on the basis of payment, especially, without the following list being in any way limitative or prescriptive, those such as books or other works, guides, postcards, posters, etc.
  • For promotional or publicity campaigns where space is purchased.

1.7. The User undertakes not to reproduce the Photographs in media other than those mentioned on the information sheet linked to each Photograph ([] symbol).

1.8. The authorisation to make use of the Photographs comes to an end on the date indicated in the information sheet linked to each Photograph ([] symbol).

1.9. The User undertakes to let the RTC (see article 2.3) have 2 copies of each publication as proof of publication. For online publications, the User undertakes to let the RTC have the address of the website where the Photographs can be seen.

1.10. This authorisation to use the Photographs is granted by the RTC to the User on a strictly personal basis. The User is thus prohibited from assigning the benefits of this authorisation to third parties, whether free of charge or in return for payment.

1.11. The User undertakes to mention the photographic credits on each reproduction and/or representation of the Photographs. The User is strictly prohibited from modifying the wording of the photographic credit (in particular the photographer’s name) linked to the Photographs.

1.12. The User undertakes to comply with the moral right of the authors under all circumstances and not to harm the honour or reputation of the authors of the Photographs, models and/or the RTC.

2. Guarantees

2.1. The User has the benefit of secure access to the Photographs via a user name and password. The User undertakes under all circumstances to keep their user name and password secret and not to communicate them to any third party. The User is responsible for any use made of their user name and password and for any use/exploitation of the Photographs arising from this. In the event of the confidentiality of the user name and password no longer being ensured, the User undertakes to inform the RTC about this immediately.

2.2. The User guarantees the RTC against any complaint that might be made or action that might be taken by third parties against the RTC due to unauthorised use of the Photographs and/or violation of the GCU. In particular, the User undertakes to reimburse the RTC for all the costs (including legal costs) and sentences arising from this violation, which the RTC might have to pay, and to compensate them for all the damages suffered.

2.3. The personal data supplied by the User when their account is created are subject to automatic processing. In compliance with articles 39 et seq. of law no. 78-17 of 6 January 1978 amended in 2004 pertaining to information technology, computer files and liberty (French data protection act), anyone may have the information concerning them communicated to them and, where appropriate, corrected or deleted, by contacting

The information gathered is subject to computer processing designed to ensure follow-up of the services offered by the RTC. The RTC is the sole recipient of these data. It undertakes not to give, sell or assign them in any way whatsoever. The User can also object to the processing of the data that concerns them for legitimate reasons.

3. Rules relating to the GCU

3.1. The RTC reserves the right to amend or update the GCU at any time, without prior notice. The version of the GCU which is in force is displayed as from the date on which an amendment takes effect.

3.2. The User is deemed to have read the GCU in force at the time of each use/exploitation of the Photographs.

3.3. In the event of a failure to comply with the GCU, the RTC reserves the right to take sanctions against the User, and thus to restrict, suspend or permanently prohibit access to its service, this being without prejudice to any legal action.

4. Applicable law

4.1. The GCU are governed by French law.

4.2. Any dispute relating to the GCU comes under the exclusive jurisdiction of the tribunals of the Appeal Court of Rennes.
